We successfully obtained Workers’ Compensation coverage for his medical treatment, wage loss, and extensive rehabilitation. • Personal Injury and Workers’ Compensation Settlement - 2016 $1,050,000

Our Client, a water truck driver working in the oil fields of Montana and North Dakota, was severely injured when he was run off the road by another semi-truck. Initially, his Workers’ Compensation claim was filed in North Dakota, where benefits are less favorable compared to Montana. We were able to get his claim transferred to Montana and accepted by the Montana workers’ compensation insurer, which was a significant benefit to our client because he was not required to pay back any of his worker’s compensation benefits after we obtained a favorable third-party settlement against the at fault truck driver (he would have had to pay back his workers’ compensation benefits if that claim had been processed under North Dakota law). When the client first contacted us, he was unaware of his right to pursue a claim against the at-fault driver, and only wanted help getting approval for medical treatment through workers’ compensation. In addition to medical and wage loss benefits, we obtained favorable settlements for his Workers’ Compensation claim and third-party claim against the at fault truck driver totaling $1,050,000.00.

After investigating the claim, our firm determined that a claim could be brought against the general contractor for the project. At the time our client contacted us, he was homeless, had his workers’ compensation benefits terminated, and had not obtained necessary medical treatment due to the workers’ compensation insurer denying all future medical treatment. After retaining our firm, we were able to assist our client in finding housing, re-opened his workers’ compensation claim, forced the insurer to start paying wage loss benefits as well as necessary medical treatment. We then pursued actions against the insurer for the driver that struck him, and obtained all available insurance limits.

Our Client, who had been permanently and totally disabled for worker’s compensation purposes since 1991, asked for our help in negotiating a settlement for her claim related medical benefits. This presented many complicated issues given our Client’s status as a Medicare beneficiary. We were able to obtain a favorable Medicare Set Aside projection, approval by Medicare of that figure, and a significant sum of money above and beyond the Medicare set-aside amount, totaling $350,000.00, which allowed our Client to use the “to boot” settlement proceeds for medical treatments that were not otherwise covered by traditional workers’ compensation and Medicare coverage. Plus, our Client was pleased to “get out” of the Worker’s Compensation system and its frustrating requirements of preauthorization, medical care within the Utilization and Treatment Guidelines, etc.
